Clarity Terms of Use
Please read this first: Clarity’s captions and summaries are produced automatically and can be wrong or incomplete. Clarity is not a medical device and is not a replacement for hearing aids, professional captioning or interpreters. Do not rely on it for emergencies or for medical, legal, financial or safety decisions. You are responsible for following the laws that apply to listening to and transcribing conversations where you use it.
1. Agreement
These Terms of Use (“Terms”) are an agreement between you and Solaris Wave LLC (“Solaris Wave”, “we”, “us”) for your use of the Clarity mobile application and related services (“Clarity”). By downloading or using Clarity you agree to these Terms and to our Privacy Policy. If you do not agree, do not use Clarity.
2. What Clarity does
Clarity uses your device’s microphone to turn nearby speech into live captions labeled by speaker, saves transcripts on your device, and can create short summaries. Speech recognition, speaker detection and summaries run on your device using AI models that Clarity downloads once. Features, supported languages and devices may change over time.
3. Eligibility
You must be at least 13 years old to use Clarity. If you are under the age of majority where you live, you may use Clarity only with the involvement of a parent or guardian who agrees to these Terms.
4. License
We grant you a personal, limited, non-exclusive, non-transferable, revocable license to download and use Clarity on Apple-branded devices that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions. You may not copy (except as allowed by those rules), modify, distribute, sell, rent, reverse engineer, or create derivative works of Clarity, except where such restrictions are prohibited by law or by the licenses of included open-source components.
5. Important limitations — accuracy, health and safety
- Captions and summaries may be inaccurate. They can miss words, mishear names, numbers and dates, attribute speech to the wrong person, or (for summaries) omit or misstate details. Always confirm important information with the people involved or the full transcript.
- Not a medical device. Clarity is not intended to diagnose, treat, cure or prevent any condition, and is not a hearing aid or a substitute for one, or for professional captioning (CART) or sign-language interpretation.
- Not for emergencies or critical decisions. Do not rely on Clarity in emergencies or for medical, legal, financial or safety-critical decisions.
6. Your responsibilities, consent and recording laws
Laws about listening to, transcribing or recording conversations vary by place and may require the consent of everyone in the conversation. You are solely responsible for using Clarity lawfully, including telling people that their speech is being captioned and getting any consent required. Do not use Clarity to capture conversations you are not permitted to, or in ways that violate others’ rights or privacy. Do not use Clarity for any unlawful purpose.
7. Your content
Transcripts, speaker names and summaries you create (“Your Content”) belong to you. They are stored on your device; we do not receive or have access to them, as described in the Privacy Policy. You are responsible for Your Content and for anything you choose to share from Clarity.
8. AI features
Clarity’s AI models run on your device. How they work and their limits are explained in our AI Transparency page. AI output is provided “as is” and is not professional advice.
9. Downloads and third-party components
Clarity downloads AI models from storage we operate on Cloudflare. Clarity includes open-source software and models provided under their own licenses (listed on our Open-Source Licenses page), including software adapted from the EchoAssist project (MIT License) and AI models licensed by NVIDIA Corporation under the NVIDIA Open Model License; those licenses govern those components, and nothing in these Terms limits your rights under them.
10. Purchases and subscriptions
Using Clarity after setup requires an auto-renewing Clarity subscription sold through the App Store (monthly or yearly). New subscribers may be offered a free trial; its length, and the current prices in your currency, are shown in the app before you subscribe. You don’t need an account with us: the subscription belongs to your Apple Account, and we never receive your payment details.
- Payment is charged to your Apple Account at confirmation of purchase, or when a free trial ends unless you cancel at least 24 hours before it ends.
- Subscriptions renew automatically at the same price and period unless auto-renew is turned off at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the end of the current period.
- You can manage or cancel subscriptions in Clarity (Settings → Subscription → Manage) or in your Apple Account settings. Cancelling stops the next renewal; you keep access until the end of the period you paid for. Any unused portion of a free trial is forfeited when you purchase a subscription.
- We may change prices; Apple notifies you before a price increase applies to your subscription, as its rules require.
- Refunds are handled by Apple under its policies.
11. Updates and changes to Clarity
We may update, change, suspend or stop any part of Clarity at any time. Some updates may be required to keep using Clarity.
12. Intellectual property
Clarity, including its design, text, graphics and software (other than open-source components and Your Content), is owned by Solaris Wave LLC or its licensors and protected by law. “Clarity” and “Solaris Wave” names and logos may not be used without our permission.
13. Disclaimer of warranties
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CLARITY IS PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT CLARITY WILL BE ERROR-FREE, UNINTERRUPTED, OR THAT CAPTIONS OR SUMMARIES WILL BE ACCURATE OR COMPLETE.
14. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SOLARIS WAVE LLC WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF (OR INABILITY TO USE) CLARITY, INCLUDING RELIANCE ON CAPTIONS OR SUMMARIES. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID FOR CLARITY IN THE 12 MONTHS BEFORE THE CLAIM OR US $50. Some jurisdictions do not allow these limitations, so they may not apply to you.
15. Indemnification
You agree to indemnify and hold harmless Solaris Wave LLC from claims, damages and expenses (including reasonable attorneys’ fees) arising from your misuse of Clarity or your violation of these Terms or of any law or third-party right, including laws about recording or transcribing conversations.
16. Termination
You may stop using Clarity at any time by deleting it. We may suspend or end your license if you violate these Terms. Sections that by their nature should survive termination (including 5, 7, 12–15 and 18) will survive.
17. Apple App Store terms
If you obtained Clarity from Apple’s App Store:
- Acknowledgement. These Terms are between you and Solaris Wave LLC only, not Apple Inc. (“Apple”). Solaris Wave, not Apple, is solely responsible for Clarity and its content.
- Scope of license. Your license is limited to use on Apple-branded products you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions.
- Maintenance and support. Solaris Wave is solely responsible for maintenance and support of Clarity (see Support). Apple has no obligation to provide maintenance or support.
- Warranty. To the extent any warranty is not effectively disclaimed, Solaris Wave is responsible for it. If Clarity fails to conform to an applicable warranty, you may notify Apple and Apple will refund the purchase price (if any). To the maximum extent permitted by law, Apple has no other warranty obligation with respect to Clarity.
- Product claims. Solaris Wave, not Apple, is responsible for addressing any claims relating to Clarity or your use of it, including product liability claims, claims that Clarity fails to meet legal or regulatory requirements, and claims under consumer protection, privacy or similar laws.
- Intellectual property claims. If a third party claims that Clarity or your use of it infringes their intellectual property rights, Solaris Wave, not Apple, is solely responsible for the investigation, defense, settlement and discharge of that claim.
- Legal compliance. You represent that you are not located in a country subject to a U.S. Government embargo or designated as a “terrorist supporting” country, and that you are not on any U.S. Government list of prohibited or restricted parties.
- Developer contact. Questions, complaints or claims: Solaris Wave LLC, admin@artmento.org.
- Third-party terms. You must comply with applicable third-party terms (such as your wireless carrier’s) when using Clarity.
- Third-party beneficiary. Apple and its subsidiaries are third-party beneficiaries of these Terms and, once you accept them, Apple will have the right to enforce these Terms against you as a third-party beneficiary.
18. Governing law
These Terms are governed by the laws of the United States and the State of Georgia, without regard to conflict-of-law principles, except where the law of your place of residence requires otherwise.
19. Changes to these Terms
We may update these Terms. We will change the date above and, for significant changes, tell you in the app or on this page. Continuing to use Clarity after changes take effect means you accept them.
